Vidgenlab provides an AI-powered video generation platform that allows users to create videos from text prompts, images, or reference videos using advanced artificial intelligence models. Our Service includes:

  • Text-to-video generation using AI models (e.g., Sora 2, Veo 3.1, Wan 2.6, Seedance 1.5 Pro)
  • Image-to-video generation capabilities
  • Reference video generation features
  • API access for developers and businesses
  • User account management and video history storage
  • Credit-based payment system for video generation

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

3. User Accounts

3.1 Account Registration

To use certain features of our Service, you must create an account. When you create an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security of your password and account
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

3.3 Account Termination

You may delete your account at any time through your account settings. We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activity.

4. Payment Terms

4.1 Credits and Pricing

Our Service operates on a credit-based system. Credits are required to generate videos. Credit costs vary based on the AI model selected, video duration, resolution, and other parameters. Current pricing is displayed on our pricing page and may be updated from time to time.

4.2 Payment Processing

Payments are processed through secure third-party payment processors (e.g., Stripe). By making a purchase, you agree to the payment processor's terms and conditions. We do not store your full credit card information on our servers.

4.3 Refunds

Credits purchased are non-refundable except as required by law. If you experience technical issues that prevent you from using purchased credits, please contact our support team at support@vidgenlab.com within 30 days of purchase. We will review refund requests on a case-by-case basis.

4.4 Subscription Plans

If you subscribe to a recurring plan, you will be billed automatically on a monthly or annual basis until you cancel. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.

5. Acceptable Use

You agree not to use the Service:

  • For any illegal purpose or in violation of any laws
  • To generate content that is defamatory, harassing, abusive, threatening, or discriminatory
  • To create content that infringes on intellectual property rights, privacy rights, or other rights of third parties
  • To generate explicit, pornographic, or adult content
  • To create content that promotes violence, hate speech, or illegal activities
  • To impersonate any person or entity or misrepresent your affiliation with any person or entity
  • To interfere with or disrupt the Service or servers connected to the Service
  • To attempt to gain unauthorized access to any portion of the Service or any other systems or networks
  • To use automated systems (bots, scrapers) to access the Service without our written permission
  • To reverse engineer, decompile, or disassemble any part of the Service
  • To resell or redistribute the Service or any content generated through the Service without authorization

We reserve the right to review, remove, or refuse to generate any content that violates these Terms. Violation of these Terms may result in immediate termination of your account and legal action.

6. Intellectual Property Rights

6.1 Our Intellectual Property

The Service, including its original content, features, functionality, design, logos, trademarks, and software, is owned by Vidgenlab and protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 Your Generated Content

You retain ownership of videos and content you generate using our Service, subject to the following:

  • You grant us a worldwide, non-exclusive, royalty-free license to use, store, and display your generated content solely for the purpose of providing and improving the Service
  • You are responsible for ensuring your generated content does not infringe on third-party rights
  • You may use your generated content for commercial purposes, subject to compliance with these Terms

6.3 User Content

By uploading images, text prompts, or other content to our Service, you represent and warrant that you own or have the necessary rights to use such content and that it does not violate any third-party rights.

7. API Access

If you use our API, you agree to comply with our API usage guidelines, rate limits, and any additional terms provided with the API documentation. API access may be subject to separate fees and terms.

We reserve the right to limit, suspend, or terminate API access if you violate these Terms or engage in abusive API usage patterns.

8. Service Availability and Modifications

We strive to maintain high availability of our Service, but we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, technical issues, or circumstances beyond our control.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable for any loss or damage resulting from such modifications, suspensions, or discontinuations.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability, fitness for a particular purpose, or non-infringement
  • Warranties that the Service will be uninterrupted, secure, or error-free
  • Warranties regarding the accuracy, reliability, or quality of generated content
  • Warranties that defects will be corrected

AI-generated content may contain inaccuracies, errors, or unexpected results. We do not guarantee the accuracy, quality, or suitability of generated content for any particular purpose.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIDGENLAB AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SUPPLIERS SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Damages resulting from use or inability to use the Service
  • Damages resulting from unauthorized access to or alteration of your data
  • Damages resulting from third-party conduct or content

Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim, or $100, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless Vidgenlab and its affiliates, officers, directors, employees, agents, and suppliers from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you generate, upload, or share through the Service

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will cease immediately. We may delete your account and all associated data, including generated content, subject to our data retention policies outlined in our Privacy Policy.

You may terminate your account at any time by deleting it through your account settings or contacting us at support@vidgenlab.com.

13. Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions.

13.2 Dispute Resolution Process

If you have a dispute with us, you agree to first contact us at support@vidgenlab.com to attempt to resolve the dispute informally.
